Consent to Personal Data Processing

When using geolocation in MeteoCare.RU

This is a translation provided for convenience. The Russian-language text is legally binding, and the Russian version prevails in the event of any discrepancy.

In accordance with Federal Law No. 152-FZ of 27 July 2006 "On Personal Data" (Russian Federation), having read the MeteoCare.RU Privacy Policy and Personal Data Processing Rules, I, the data subject, hereinafter referred to as the "User," freely, of my own will and in my own interest, give specific, informed, conscious, and unambiguous Consent to the processing of personal data on the following terms.

1. Personal Data Operator

1.1. Consent is given to Pavel Andreevich Kiselev (hereinafter — the Operator), an individual applying the special tax regime "Professional Income Tax" (self-employed status; Russian: "самозанятый"), address: 117403, Russian Federation, Moscow, Biryulyovo Zapadnoye Municipal District, Kharkovskaya St., 3, bldg. 8, apt. 108, email: info@1294studio.ru.

2. Personal Data Covered by this Consent

2.1. This Consent applies exclusively to the following data:

  • the device's precise or approximate coordinates, provided by the operating system after the User grants system-level permission for geolocation access;
  • the date and time the coordinates are obtained, and the technical request parameters needed to determine the nearest supported city.

2.2. This Consent does not apply to the installation UUID, IP address, the city selected by the User, the city identifier, or information about the platform, Application version, build number, technical errors, and security events. Processing of such data to provide network functions, technical operation, and security is carried out on other legal grounds set out in Section 6 of the Personal Data Processing Rules.

2.3. This Consent does not apply to the advertising identifier or other data used for advertising personalization. A separate Consent is obtained for advertising personalization.

2.4. Wellbeing diary entries are not sent to the Operator's server, are not covered by this Consent, and are not used by the Operator for advertising, analytics, or profiling.

3. Purpose of Processing

3.1. The device's coordinates are processed exclusively to determine the nearest supported city and to provide the User with weather and geomagnetic information for that city.

3.2. The Operator does not compile a history of the User's movements and does not use the coordinates for advertising, profiling, or determining health status.

4. Processing Operations and Methods

4.1. Processing is carried out by automated means using the Application, the User's device, MeteoCare.RU server infrastructure, and the Internet.

4.2. The data specified in clause 2.1 may be subject to receipt, collection, recording in a technical log for a limited period, retrieval, use for determining the city, blocking, deletion, and destruction.

4.3. Data is not disseminated to an indefinite group of persons on the basis of this Consent.

5. Data Recipients

5.1. The coordinates are transmitted to the MeteoCare.RU server over a secure connection and may be processed by server and network infrastructure providers acting under the Operator's instructions, solely to the extent necessary for the API's operation, technical logs, and security.

5.2. The device's coordinates are not transmitted to the Yandex Mobile Ads SDK, YANDEX LLC (Russian: ООО «ЯНДЕКС»), or advertising-infrastructure participants via the advertising SDK. The use of location data for ad targeting has been disabled by the Operator programmatically using the advertising SDK's built-in tools.

5.3. Data may be disclosed to authorized government bodies only in the cases and in the manner provided for by the legislation of the Russian Federation.

6. Giving Consent and the Voluntary Nature of Geolocation

6.1. Consent is given by a separate, active action in the Application's interface and is confirmed by the operating system's permission granting geolocation access.

6.2. The User is entitled not to give Consent or system permission. This does not restrict access to the Application's core functions: the User may select a city manually.

6.3. Consent is given by a User who has reached 18 years of age.

7. Processing and Retention Period

7.1. Coordinates are used when the corresponding request is executed and are not retained by the Operator as a location history.

7.2. Coordinates and their associated technical parameters may be temporarily retained in technical request logs, which are generally kept for no more than 90 calendar days. If an incident is identified, records related to it may be retained until the investigation is completed and mandatory legal requirements are fulfilled.

7.3. Records confirming that this Consent was given or withdrawn may be retained for up to three years after withdrawal or the last event related to the application of the Consent, to confirm compliance with legal requirements and to protect the Operator's rights.

8. Withdrawal of Consent

8.1. The User may withdraw Consent at any time by disabling the Application's geolocation access permission in the operating system settings, or by selecting the manual city-selection mode in the Application, in which coordinates are not requested.

8.2. Withdrawal applies to subsequent processing from the moment the corresponding setting is changed. After withdrawal, the Application stops any further receipt and transmission of coordinates.

8.3. Withdrawal of Consent does not affect the lawfulness of processing carried out before the withdrawal and does not terminate the processing of other data carried out on the basis of the Terms of Use, the Operator's legitimate interests, or legal requirements.

8.4. Deleting the Application stops any further receipt and transmission of coordinates from the corresponding device.

9. Confirming that Consent was Given

9.1. To confirm that Consent was given or withdrawn, the Operator may record the installation UUID, the date and time, the Application version, the build number, the platform, the distribution channel, the state of the geolocation setting, and the revision identifier MC-CONSENT-PD-1.3.

9.2. This information is used to record Consent and confirm compliance with legal requirements, not to identify the User.

10. Final Provisions

10.1. Before giving Consent, the User is given the opportunity to review the Privacy Policy, the Personal Data Processing Rules, the purpose, the list of data, the recipients, the processing periods, and the procedure for withdrawing Consent.

10.2. General inquiries regarding the processing of personal data may be sent to info@1294studio.ru or to the Operator's postal address. Because the Application does not involve registration and the Operator does not establish the User's identity, an email inquiry alone is not used as a means of changing the system geolocation permission or confirming that particular technical records belong to a specific individual.
